1. Acceptance of Terms
By accessing or creating an account on any website or application operated by Ogotto Holdings Limited ("Ogotto," "we," "our," or "us"), you agree to comply with and be bound by these Terms of Service. These terms apply to all Ogotto platforms including UtambuliSSO, Tusonge Pamoja (Ogotto Pay), and Rohotrek.
2. Single Sign-On (SSO) & UtambuliSSO
Ogotto uses UtambuliSSO (our AGPLv3 open-source identity engine) for centralized user authentication. Creating an account provides a unified identity across all Ogotto products. You are responsible for maintaining the confidentiality of your login credentials and multi-factor authentication devices, and for all activities conducted under your account.
3. KYC & Identity Verification Obligations
To access financial features (such as chama savings management) or verified social profiles, you agree to complete our Know Your Customer (KYC) verification process by submitting accurate, valid government-issued identification (Kenyan National ID, Passport, KRA PIN, and mobile number). Providing false or fraudulent identity details will result in immediate account termination.
4. Product Terms: Tusonge Pamoja / Ogotto Pay
Tusonge Pamoja (Ogotto Pay) provides digital coordination and record-keeping software for rotating savings, chamas, and community investment groups:
- Chama Administration: Groups establish their own contribution terms, payout schedules, and member rules. Ogotto acts as a technology provider, not a bank or financial institution.
- Non-Banking Software Disclaimer: Funds transferred or tracked within chamas are processed through licensed Kenyan payment service providers (e.g., M-PESA). Ogotto does not take deposits or guarantee returns on group investments.
- Ledger Accuracy: Members are responsible for reviewing and confirming group financial entries and multi-signature payout authorizations.
5. Product Terms: Rohotrek
Rohotrek is a social networking platform for dating and connecting with travel companions:
- Age Requirement: You must be at least 18 years of age to register or use Rohotrek.
- User Conduct & Safety: You agree not to engage in harassment, hate speech, impersonation, unsolicited commercial solicitations, or fraudulent activities.
- Travel Companion Disclaimer: Users are solely responsible for verifying travel plans, meeting safety, and personal security when coordinating with travel companions offline.
- Content License: You retain ownership of photos and content posted to Rohotrek, but grant Ogotto a worldwide, non-exclusive license to host and display your content on the platform.
6. Intellectual Property & Open Source
The core UtambuliSSO identity engine software is released under the GNU AGPLv3 open-source license. All proprietary branding, logos, design assets, and commercial application code for Tusonge Pamoja (Ogotto Pay) and Rohotrek remain the exclusive intellectual property of Ogotto Holdings Limited.
7. Governing Law & Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising out of or in connection with these terms or use of Ogotto platforms shall be submitted to the exclusive jurisdiction of the competent courts of Kenya.
